Neighbours refuse to remove plant supports from my brand new fence. What can I do without incurring legal fee?

After a year of saving, l am now in the middle of having a new fence Little Pantz erected. Cost runs into 4 figures. l had to replace the old one when part Registered User of it blew down last year.When the old fence was taken down l found my Joined: Monday, 14th of June 2010, 22:48:52 elderly neighbours had nailed all sorts to it, including batten, trellis, Posts: 196 wire, even pet memorial plaques. l asked them not to attach anything to Viewed 18390 times the new fence.
Half the fence was put up yesterday, but is
unstable due to the gound being extremely waterlogged & work has been
paused.Even before the concrete had set around the posts my neighbours
fixed wire to my fence to support an 18ft rose.
The fence is
mine, (as marked on my deeds), is being erected completely on my land &
being paid for by me.
l politely asked my neighbours to remove
the plant supports from my fence. They refused, became abusive & said they
would not remove similar supports from my patio wall either, (this was
news to me).l will go to CAB, but what else can be done that wont incur
legal fees?

OK - so they are wrong to interfere with ur fence without ur Skipper permission but at the end of the day - are the plant supports / trellises Registered User damaging ur fence. I mean - really damaging it or showing through on ur Joined: Monday, 31st of May 2010, 06:32:07 side? If they are, I'd get serious with them, but if they are not, then Posts: 954 may be better for you to try & chill about this (not easy I understand as Viewed 17472 times ur neighbours sound rude to me). These type of things have a habbit of
sprawling out of control & can make for a very unpleasant living
environment. None of us ever know when we will need to rely on a good
neighbour for help. I think, that if they want to use ur fence to support
their plants, they should at least have the manners to offer you some money
towards the cost of this fence.
Actually - I have just re-read ur question. They are just plain rude &
yes - they probably have damaged ur fence by interfering with it before
the concrete had set. If they continue to behave in this manner, I would
just rip their supports off the fence. You own it after all !

They have no right to attach anything but I don't envy you the TwinKie feud with ur neighbour that will follow this - sadly you will all be Registered User losers when you fall out. You can remove anything they attach; send them Joined: Tuesday, 25th of May 2010, 08:35:20 a solicitors letter (you should get a free half hour legal consultation) Posts: 2000 asking them to desist; get the local Community Police Officer to have a Viewed 10825 times word (it is causing damage to ur property with intent) or put the rest of
the fence up & try & ignore what is happening on the other side. You say
they are elderly so the problem may go away eventually. Best of luck

creosote it, so anything tied to it will either die or be SMARTIE turned brown, or while you are there put a chicken wire fence along their Registered User side, attaching it to the posts as you go. You know that is just plain rude of your neighbors, but if you lollipop do not see that side of the fence, then it isn't hurting anything & seems Registered User to make your neighbors happy. Is this fence directly on the property line? Joined: Sunday, 9th of May 2010, 03:56:03 If so you should have installed the fence closer inside the property line. your fence your property take it down. When they get mean, call BAshFUl the police. Yea my neighbour refused to take the trees outta the fence Registered User because he liked them. So i hopped over and chopped them all down. He got Joined: Monday, 3rd of May 2010, 11:31:52 angry so i called the cops and they told him not to do it or else i could Posts: 1183 take legal action. Legally you can remove these yourself & there is not a thing bae =) they can do about it. It is ur property, especially ur patio, & they are Registered User in the wrong for attaching things to anything you pay for as long as the Joined: Saturday, 15th of May 2010, 06:08:47 fence is on ur property or property line. Also, if any trees of theirs or Posts: 470 plants hang over the fence you are able to cut these off as no neighbor is Viewed 15737 times allowed to have anything hanging over ur fence or crossing the property
boundary. If they refuse i would contact ur local police officer to come
by & explain this to them. Also, if they have nailed anything to it they
must by law pay for any damages they have done to ur fence. The best way
to handle it is to save all receipts & take photos of the damage they have
done.
